# Berufsrecht KI-Vertragsprüfung

> German AI-contract pre-check: reviews contracts with legal-AI providers against German professional secrecy rules (§ 43e BRAO, § 203 StGB).

Berufsrecht KI-Vertragsprüfung, roughly "AI contract check under professional rules", is a community Claude plugin by Klotzkette from the claude-fuer-deutsches-recht collection for German legal practice. It's for law firms and other German professionals bound by secrecy (tax advisers, auditors, patent attorneys and notaries) who want to use a legal-AI tool and need to look at the provider's contract first. Its skills run a structured pre-check of that contract under German professional and criminal law on confidentiality, chiefly § 43e BRAO (lawyers' rules for outside service providers) and § 203 StGB (breach of professional secrecy), with data protection and the EU AI Act alongside. The skills are written in German and answer in German.

What you can do with it
- Sort out what kind of tool you're dealing with: a consumer AI tool, an enterprise tool, law-firm software or a service provider under § 43e BRAO
- Go through the provider contract point by point: the confidentiality clause, the instruction on criminal liability under §§ 203 and 204 StGB, subcontractors, protection from seizure under §§ 53a and 97 StPO, security measures and certifications (ISO 27001, BSI C5), no-training and data retention, and transfers outside the EU, including the US CLOUD Act
- Get a pre-check report that rates each point green, amber or red, with a list of gaps and next steps
- Write a letter to the provider asking about the promises its contract doesn't back up
- Draft clauses to negotiate, such as confidentiality, no training, zero retention, EU hosting, a subcontractor list and a professional-secrecy addendum for US providers
- Apply the same check to the parallel rules for tax advisers, auditors, patent attorneys and notaries
- Look at the firm's own role under the EU AI Act, the Article 50 transparency duties, and how to handle unapproved "shadow AI" tools

How it works
It's a Claude plugin made of skills, installed from Klotzkette's own marketplace (klotzkette-german-legal-skills). Tell it your profession, the provider and the kind of data involved, or hand it the contract documents, and ask for the check, a letter or clauses. It installs many skills; the plugin's README lists the core ones, and the author suggests naming the skill you want, because automatic skill choice isn't guaranteed.

Good to know
- The author calls it a pre-check: a structured aid for talking to the provider, expressly not legal advice and not a full legal opinion. Judging the individual case stays with the firm or a specialist lawyer, and the author describes the whole collection as an experiment whose results can be wrong, incomplete or out of date.
- Its clause texts are templates, not finished contracts.
- Whether you may put client data into an AI tool at all, including this one, is for you to check. The author takes no position on it.
- It's a community project, not made by a bar association or by Anthropic.
